
An employee of the Umkhonto Wesizwe (MK) Party has unleashed his lawyers on the ANC’s splinter party to force it to reinstate an employment contract and salary that has been revised.
Srinivasen V Naidoo, who was administration clerk at the party’s constituency offices in the Moses Mabhida region in KwaZulu-Natal, told the party through his lawyers from Mabhida Inc to reinstate the contract or face legal action.
Naidoo contends that the party unilaterally decided to change his contract in a meeting that was held in Durban in February. His salary was changed from R23 000 to R17 000 and his contract was cut from 5 years to one year.
Furthermore, he claims that the party decided to reintroduce a probationary period of three months, thereby rescinding Naidoo’s permanent employee status as of 1 January 2025.
“These actions constitute constructive dismissal and amount to clear transgressions under several legal provisions,” Naidoo’s lawyer said in a letter that was addressed to Floyd Shivambu, the MK Party’s Secretary-General.
Naidoo confirmed to African Times that he has instructed his lawyers to handle the matter since the party ignored his letters.
“Floyd wants to close all constituency offices as well. This is the Life blood of any political party. And MK is a grassroots people’s party. We have to be where the people are.
“More constituency offices is better, but Floyd wants only 11 in KZN, meaning that most people would have to travel a hundred km to the nearest constituency office.
“The previous leadership who are now suspended created 26 offices with plans for more leading up to 2026 Local Government Elections. Sabotage I suspect (sic),” Naidoo told African Times.
The spokesperson of the MK Party, Nhlamulo Ndhlela said he was going to check with Shivambu whether he has received the letter or not.
