
Oupa Brown Mogotsi’s bid to secure bail on new facts continued in the Johannesburg Magistrates’ Court on Tuesday, with the State pressing him on his version of events surrounding an alleged shooting incident in Vosloorus.
Mogotsi, who faces several serious charges, took the witness stand to support his application before being cross-examined by the State.
The matter was postponed to September 11, 2026, for the continuation of the State’s cross-examination.
The National Prosecuting Authority (NPA) said it would continue opposing Mogotsi’s application and present its case in accordance with the applicable legal processes.
Mogotsi is facing charges of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a built-up area, defeating or obstructing the administration of justice and perjury.
The charges stem from an alleged incident in Vosloorus on November 3, 2025.
According to the allegations before the court, Mogotsi reported to police that he had been driving alone in Vosloorus when occupants of a bakkie allegedly pursued him.
He told police that the occupants fired multiple shots at his vehicle, forcing him to stop and flee on foot.
The circumstances surrounding the incident form part of the State’s case against Mogotsi, who has now sought to secure his release through a bail application based on new facts.
During Tuesday’s proceedings, Mogotsi gave evidence in support of his application and presented his version of events, including his account of an alleged escape plan.
He was subsequently subjected to cross-examination by the State, which is challenging his evidence and the basis for his request to be released on bail.
The court did not conclude the cross-examination on Tuesday and postponed the matter to September 11.
The NPA said the continuation of proceedings would allow the State to complete its questioning of Mogotsi before the court considers the evidence placed before it.
The prosecution’s decision to oppose bail means Mogotsi’s legal team will have to persuade the court that the new facts presented justify his release despite the charges he faces.
The State, meanwhile, will continue placing its arguments before the court and challenging Mogotsi’s version where necessary.
Bail proceedings based on new facts generally require an accused person to demonstrate that circumstances or information not previously considered by the court warrant reconsideration of an earlier bail decision.
Mogotsi’s latest application has therefore placed his version of the alleged shooting, his circumstances and the new information before the Johannesburg Magistrates’ Court for consideration.
The NPA’s Gauteng Division in Johannesburg confirmed that the prosecution would continue to oppose the application.
NPA Gauteng spokesperson Magaboke Mohlatlole said the State would continue presenting its case through the appropriate legal processes.
The next court appearance on September 11 is expected to focus on the continuation of the State’s cross-examination of Mogotsi.
The outcome of the bail proceedings will determine whether he remains in custody or is released pending the continuation of his criminal case.
For now, the prosecution maintains its opposition to his release, while Mogotsi continues to argue for bail based on the new facts placed before the court.
